Terms of Service
Effective July 1, 2026
These Terms of Service govern your access to and use of NWX global services' website, products, and consulting services. By engaging with us, you agree to these terms. Please read them carefully.
Acceptance of Terms
By accessing or using the NWX global services website and services, you agree to be bound by these Terms of Service. If you do not agree, do not use our services. These terms may be updated periodically, and continued use after changes constitutes acceptance.
Services Description
NWX global services provides custom software development, cloud infrastructure, AI/ML solutions, IT staff augmentation, consulting, and digital marketing services. Specific scope, deliverables, and timelines are defined in individual Statements of Work executed separately from these terms.
Intellectual Property
Upon full payment, all custom code, configurations, and deliverables produced specifically for your engagement are transferred to you. NWX retains the right to use generalized knowledge, methodologies, and non-client-specific tooling developed during engagements.
Confidentiality
Both parties agree to maintain confidentiality of all non-public information shared during the engagement. This obligation survives termination of the agreement for a period of three years. Confidential information does not include publicly available data or independently developed knowledge.
Data Protection and Security
NWX implements appropriate technical and organizational measures to protect client data, including encryption at rest and in transit, access controls, and regular security audits. Clients retain full ownership of their data. NWX processes data only as necessary to deliver the agreed services.
Limitation of Liability
To the maximum extent permitted by law, NWX's liability for any claim arising from these terms or the services is limited to the fees paid for the specific engagement giving rise to the claim. NWX is not liable for indirect, incidental, or consequential damages.
Service Level Agreements
SLAs for uptime, response times, and support availability are defined in individual Statements of Work. Standard SLAs include 99.99% infrastructure uptime, 4-hour critical incident response, and 99.7% pipeline uptime for monitored deployments.
Termination
Either party may terminate an engagement per the notice period specified in the applicable Statement of Work. Upon termination, NWX will deliver all work product completed to date and assist with transition to your team or alternative provider.
Governing Law
These terms are governed by the laws of the State of Texas, United States, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Travis County, Texas.
